DOJ Gives Congresswoman Five Days To Answer Federal Charges, Five Of Which She Just Gave Birth

NEWARK, NJ, Representative LaMonica McIver gave birth to her second child last Thursday. By Friday she will need to decide whether to petition for a rehearing in a federal criminal case brought by the Trump administration, which has apparently never heard of a conflict and is not interested in starting now.
McIver, 40, is one of fifteen members of Congress in American history to give birth while serving. Fifteen. The republic is 248 years old and has produced fifteen sitting congresswomen who had children mid-term, a number so small it fits on a Post-it note with room left for someone's lunch order.
The charges stem from a May oversight visit to Delaney Hall, a Newark immigration detention facility, during which McIver allegedly had a physical confrontation with ICE agents who were blocking congressional access. The Justice Department, working under priorities set by the Trump administration, decided this constituted a crime worth prosecuting. The oversight visit itself, constitutionally protected and arguably the entire point of her job, was apparently a secondary consideration.
The DOJ has not offered an extension. The deadline is the deadline.
Attorney General Pam Bondi's office issued a statement describing the timeline as "standard procedural practice" and noting that "the American judicial system does not pause for personal circumstances." A follow-up question about whether the American judicial system had been informed a human being was involved went unanswered.
McIver's office said she is reviewing her options, which at this moment include federal appellate strategy, newborn care, and presumably some quantity of sleep deprivation so severe it should itself be submitted as evidence.
Senator Cory Booker called the prosecution "a politically motivated attack on the separation of powers" in a statement that was six paragraphs long and said nothing that could not have been accomplished in one sentence. His office confirmed the statement was in fact six paragraphs.
Republicans in the House have described the Delaney Hall incident as proof that Democrats treat ICE agents as props in an "open borders theater production," a critique that carries less weight when delivered by people who have never personally toured a detention facility or, based on available evidence, the facility's Wikipedia page.
McIver is currently the only member of Congress simultaneously managing a federal criminal appeal and a five-day-old. Legal scholars say this is unprecedented. New parents say this sounds about right.
The baby has no comment. The DOJ has several.
