Senate Lowers Impeachment Bar, Sara Duterte Immediately Walks Into It

The Philippine Senate voted this week to lower the threshold for a guilty verdict in the impeachment trial of Vice President Sara Duterte, reducing the required majority from a two-thirds supermajority to a simple majority, a change that legal scholars have described as "constitutionally creative" and that the Vice President's legal team described using a different word entirely.
Duterte, the daughter of former President Rodrigo Duterte, has been facing impeachment charges that include allegations of corruption, misuse of confidential funds, and what the formal complaint describes as "conduct unbecoming," which is the Philippine Senate's way of saying they have more charges than they have categories.
The original two-thirds requirement had been the constitutional standard. The Senate, apparently reviewing that standard mid-trial the way a poker player reviews the rulebook after looking at his hand, determined that a simpler majority would be more appropriate. For this specific situation. At this specific moment.
Senate President Francis Escudero defended the change at a press briefing Tuesday, explaining that the revision was legally sound and procedurally legitimate and that the timing was entirely coincidental, which is the same thing every referee says after calling a foul in the final two minutes of a game they have a personal interest in.
"This is not about politics," Escudero told reporters. "This is about ensuring that the rules of this body reflect the proper constitutional framework for accountability and democratic governance within the bounds of our institutional mandate." He then said several more sentences that contained no additional information.
Duterte has denied all charges. Her office released a statement calling the vote a "political persecution" and a "coordinated attack on the democratic will of the Filipino people," which is a phrase her father also used, at higher volume, to describe most of the decade he spent running the country.
If convicted, Duterte would be removed from the vice presidency and permanently barred from holding public office, including the presidency she has been positioning herself for since approximately 2022, when she began giving speeches in the tonal register of someone who has already measured the drapes.
The 2028 Philippine presidential election is still three years away. The impeachment trial is happening now. The Senate's new math makes conviction achievable with eighteen votes instead of the previous twenty-four. There are twenty-four senators. Seventeen have already voted to change the threshold, which is not a verdict but is, as one Manila political analyst put it, "a very clear weather report."
Former President Rodrigo Duterte, currently facing his own legal difficulties at the International Criminal Court in The Hague on charges related to his drug war, could not be reached for comment, as The Hague does not have great cell service and also he is under arrest.
Sara Duterte's remaining allies in the Senate have vowed to challenge the threshold change in court. Her legal team filed a motion Wednesday arguing that changing the rules of a trial during the trial is not due process, which is technically correct in the same way that pointing out the building is on fire is technically correct: accurate, urgent, and probably too late to matter.
