Candidate Issues 52-Count Indictment Against AG Who Actually Does Those

NEW YORK, NY, Republicans in New York have historically enjoyed the same electoral success as a vending machine at a juice bar, which is why Thursday's move by GOP attorney general candidate Saritha Komatireddy was notable: she decided to indict her opponent.

Not in court. Not with a grand jury. Not with a subpoena, a warrant, or any of the machinery that the office she is running for actually controls. She did it with a PDF.

The document, which Komatireddy's campaign is calling a "public indictment," contains 52 counts of what it describes as "dereliction of duty" against two-term Democratic incumbent Letitia James. Fifty-two. The number was presumably chosen because 51 felt unserious and 53 was overkill.

James, for her part, is the sitting attorney general of New York, a person whose entire professional identity is built around issuing actual indictments against actual people. She sued Donald Trump. She sued the NRA. She sued the Catholic Diocese of Buffalo. The woman indicts as a lifestyle. Getting a 52-count public indictment hand-delivered to a debate stage by someone with no prosecutorial authority is, for Letitia James, a Tuesday.

"New Yorkers deserve an Attorney General who actually enforces the law," Komatireddy said in a statement, which is a sentence that makes complete sense right up until you remember she just issued a legally meaningless court document to win a news cycle.

The 52 counts reportedly include failures to prosecute certain cases, inaction on crime, and what the campaign describes as a systematic pattern of political favoritism. None of the 52 counts have been filed with any court. None of them will be. The document cannot compel testimony, cannot result in an arrest, and cannot be enforced by any authority in the state of New York. It can, however, be emailed to reporters, which it was.

A spokesperson for the James campaign declined to comment on the indictment, which is the correct legal response to a press release.

Komatireddy, a former federal prosecutor, clearly knows what an indictment is. She has filed real ones. The strategic choice to release a fake one the night before a televised debate suggests she also knows what a headline is.

Thursday's debate will mark the first time in New York history that the defendant and her indicting party have shared a stage, technically. It will also mark the first time a political debate has functioned as an arraignment, sort of. Legal scholars are still working through it.

James leads in every public poll. Komatireddy has 52 reasons she shouldn't.
